1. You understand and agree that if you use the Services after the date on which the Terms of Service have changed, Epoch Times Blog will treat your use as acceptance of the updated Terms of Service.

2. You agree that you are solely responsible for your own use of the Service, for any posts you make, and for any consequences thereof. You agree that you will use the Service in compliance with all applicable local, state, national, and international laws, rules and regulations, including any laws regarding the transmission of technical data exported from your country of residence and all United States export control laws.

Blog Rights are protected by U.S. and international intellectual property laws. Accordingly, you agree that you will not copy, reproduce, alter, modify, or create derivative works from the Service. You also agree that you will not use any robot, spider, other automated device, or manual process to monitor or copy or steal any content from the Service. As described immediately below, Blog Rights do not include third-party content used as part of the Service, including the content of communications appearing on the Service.
Unless expressly authorized in writing by Epoch Times Blog, you agree not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes (a) any portion of the Service, (b) use of the Service, or (c) access to the Service.

5. Epoch Times Blog may, in its sole discretion, at any time and for any reason, terminate the Service, terminate this Agreement, or suspend or terminate your account. In the event of termination, your account will be disabled and you may not be granted access to your account or any files or other content contained in your account although residual copies of information may remain in our system for some time for back-up purposes.

7. You agree that if Epoch Times Blog does not exercise or enforce any legal right or remedy which is contained in the Terms of Service (or which Epoch Times Blog has the benefit of under any applicable law), this will not be taken to be a formal waiver of Epoch Times Blog's rights and that those rights or remedies will still be available to Epoch Times Blog.

8. If any court of law, having the jurisdiction to decide on this matter, rules that any provision of these Terms is invalid, then that provision will be removed from the Terms without affecting the rest of the Terms. The remaining provisions of the Terms will continue to be valid and legally enforceable.

9. You and Epoch Times Blog each agree that the Terms of Service and your relationship with Epoch Times Blog under the Terms shall be governed by the laws of the State of Georgia as they apply to agreements entered into and to be performed entirely within Georgia between Georgia residents and without regard to its conflict of laws provisions. You and Epoch Times Blog agree to submit to the exclusive jurisdiction of the courts located within Gwinnett County, Georgia and any and all claims, causes of action or disputes (regardless of theory) arising out of or relating to the Terms of Service, or the relationship between you and Epoch Times Blog, shall be brought exclusively in the courts located in Gwinnett County, Georgia. You agree to waive any and all objections to the exercise of jurisdiction over the parties by such courts and to venue in such courts. Notwithstanding this, you agree that Epoch Times Blog shall still be allowed to apply for injunctive remedies (or an equivalent type of urgent legal relief) in any jurisdiction.
